Bruce, I have a sensible question.
Are you telling me you don't have an old base unit or laptop around that you can get running for the sole reason of installing the client on it to see what you're basing your legal fight on?

If you were willing to spend a bit of time on it, you could pre-prepare such a machine with packet snooping software, browser hijacking reporting software etc. etc.

I'm honestly not sure what this case is about. I've read this thread, I've browsed the one on Rllmuk and it's no clearer.

I think I need a bullet point list of exactly what the legal argument is, because what I've read is simply about a company using tactics to extract cash from people using sexy images and promises of loot.

• Gambling sells, be it the lottery, fair ground or a slain monster in Diablo, the chance for the user to win a special glizzy prize is often enough of a draw to ensure that they have another go.
  
• Browser based game offers users the chance to play from the biggest potential platform around, Quake Live is on its way, Farmville and other Facebook apps all use the browser as its the biggest platform on the planet.
  
• Racist user generated content is sadly a fact of any user generated content, you offer the player to customise and he'll give you a giant penis, just look at Second Life. Game companies usually try to side step this trapping by stating that they're not responsible for the user generated content found, but will often try to police it the best they can.

The game from what I've read looks like nothing more than those mobile phone ring tone lines, where you txt a number and stupidly subscribe to a premium service that sends you new tones every week, charging you for each one whether you want it or not.

It's not good, it's not exactly kosher in terms of being kind to a fellow man, but it's a way of making money from people gullible enough to fall for it.

My stance with anything like this is to educate the gullible people and doing so will see the 'services' rot. Attacking the 'services' will only see you chasing one down as two more pop up.

 

I played it for a couple of weeks. (Didn't install the downloadable .exe)
Didn't spend any money. No one made me spend any money.

TCE support spawned The Chaos Edge, which in turn supported Mobi games.

When any of the three did anything, the other two would carry that information, spread it around and we could then see the amount of people who would come flocking for the current update and to keep checking for the next.

If that could be replicated with a story where the little guy also had a vested financial interest in one of the news sites, imagine what it could do in terms of ad based revenue for said site...

Just recently they consolidated the servers which caused massive discontent.

A lot of things I've read is that the game is alright, but it just had a dubious payment method (and a few other dubious things). But hey, how many game developers make money, eh?

 

Ok, ignore my second paragraph and just get an old (i.e. cheap or free) PC to install and play the game on. Then you'll be able to see if the racist material comes up straightaway unprompted, and generally get a gist of the game.

If you join a network like freecycle ( http://www.freecycle.org/ ) you'll find that people are always giving away fully functional older PC's. They are usually Pentium3's or older Pentium4's but they'll run evony well enough.

 

Dear god no! They control online gambling clearly. Its a bit like the Zynga daily raffle in Farmville and not a bit like the '000's I gamble with playing poker online every year.

The only difference is that I bet Evony dont allow me to get my money out and let me accrue coins albeit slowly during game time to gamble with for free.

 

I can't work out what financial contributions would actually be for here.

Can you turn the in-game items back into real money? If so, maybe you've got a point. Otherwise, that doesn't sound like online gambling to me.

I don't think so.
Anyone here who has been involved with anything legal will know how the expenses rack up.

If this goes to a fully fledged trial (ie not just disputing jurisdiction) then we have to prepare masses of evidence to counter every single one of their outrageous claims.

 

There wouldn't be any chance for a trial if you bothered to prepare evidence before making your outrageous claims.

 

... or perhaps ANY evidence to back up any of your own
