In this specific case, well you've already responded so just tell the court that because you are not resident etc that it doesn't have jurisdiction. Then keep quiet. The end, if or until they move the court case to somewhere closer to home.

Well the Daily Mail aren't reporting this one. And there are many hundreds of forums that have already been censored by reputation management lawyers. The Australian thing just makes it easier for them because it makes it incredibly difficult for anyone to defend.

 

Then you wait if or until they get a judgement in Australia then you fight it in the UK where you live.

Never go to where they want to fight, wait until it comes to you.

 

They probably would if you went after a specific company the same way you went after Evony. And why not? Why are you obsessed with one company when there are tons of them on the internet? You picked one target and so did they.

The point is, you're taking on bigger kids in the playground. Good for you, but do expect them to fight back, dirty or otherwise.

If I was to spend energy on activism and making the world a better place chasing companies like Evony will be very low on my list of causes just below curing mosquito's arse cancer. God knows why you decided to make it your cause.

But this is the problem here Bruce. We all have opinions, and some of us writie blogs, but very very few of us strive to make a living from that blog/site or those opinions. Nor do we push that blog towards as many people as possible in a bid to drive up traffic and therefore, revenue for ourselves.

In fact, I'll go as far as to type here 'I hate the Evony adverts, they're all over the place, and more than that, I think the game is shit'. What I wont do, is hold my breath waiting for the Evony lawyers to come and threaten to sue me.

You like trying to create controversy as that always causes spikes. I get that, thats how you make your cash, fair enough.

But, even here, you have been told over and over again that we don't want to read your blog. Or we don't need to read it unless we want too. And we don't want to read links to your blog while we're discussing other topics.

You acuse Evony of 'Spamming' for customers, yet you yourself are just as culpible.

As for the free speech thing, this isn't free speech to them. This is one organisation defending themselves against what they see as an attack from another organisation. You attacked them, plain and simple. If you can back up each and every one of your claims then obviously you have nothing to worry about. If however you have done a Jan Moir on some of the facts, then you're fucked.

And I'm sorry, but you can't go from 'I AM BRUCE ON GAMES!' when you want to start a fight or back up your opinion on a subject, then go back to a stance of 'but, I'm only bruce!' when somebody with a bigger stick fights back.

The last fighting fund was started because somebody was attacked through no fault of their own, causing them loss of revenue from a percieved 'Large Company' being cuntish. You however have started this war yourself, after being told to stop it several times.

If Mobi had decided to call thier game 'FALLOUT' and then cried because Bethesda said 'Hang on, you can't do that!' nobody would have backed Mobi. Because calling a game after another well known franchise is stupid and they should have known better.

Casting spurious allegations about a larger organisation, on a "for profit" site you control, with the content written by you was a recipe for disaster. You were warned, and more than that, you should have known better in the first place.

They threaten libel action against the authors of content that their clients don’t like, whether it is the truth or not. Those authors are then forced to withdraw that content because of the massive costs of defending their, often truthful, position. Obviously this mechanism is used most frequently by those with the most to hide. The libel law is thus being used against the interests of your constituents. In a further twist we now have a Chinese video game, Evony, with a recently incorporated Delaware front company, sueing a British blogger, Bruce Everiss, in an Australian court. They are indulging in this extreme libel tourism firstly because Australian libel judgements are enforceable in England and secondly in order to make it as difficult as possible for Mr Everiss to defend what he maintains to be a truthful position. If Evony succeed it will open the floodgates of undefendable action being taken against British people in Australian courts. As your constituent I would like to know what you are doing to maintain the freedom of speech on the internet. Also I would like to know what the government are doing to prevent the total abuse of the legal system that is happening in the case of Mr Everiss and Evony, regards, etc

sorry Bruce but as others have pointed out...this is really entierly of your own making, and continues to be so, I don't really see how you can ask TCE to back you up on this.

I suggest you make them an offer of a suitable grovelling apology and avoid shit stirring in future.

MP's are driven by public opinion, but the reality is that the seldom get direct requests for action on a particula point.
If an MP gets a letter, he'll ignore it, if he gets 2, or 3 he'll mark it as something to watch, 20...he's convinced he'll get re-elected because this is an important issue his constituents are worried about.


Bruce wants to create a situation where the MP will take notice.

If you write a blog now you are not safe from reputation management lawyers. If Evony succeed in getting this heard in Australia the reputation management legal industry will be unstoppable, they will run amok.

 

This may indeed be true......but this is not the case to fight it..becuase I think you stepped over the line in baiting them.

Problem is Bruce, that people here perceive this as your personal vendetta ever since Evony spammed your comment column in your blog. The irony of the situation has been stated above (and in other Evony-related threads on TCE) whereby many people felt you were spamming the Members Area trying to get as many eyeballs to your blog, yet when another entity employs similar tactics using your site as the conduit you scream, 'unfair!'. Yes, I know there are other factors such as the alleged gold-mining, etc but that is simply a case of caveat emptor as far as I'm concerned.

Now you are turning the whole point of the litigation around, using the pretext of defending free speech as a reason for garnering support. The problem is that your obsession with speaking out against Evony seems to have clouded your judgement and perhaps you went a little too far condemning their practices when you should have stuck to the absolute facts and presented your case more elegantly and conclusively. Courage of convictions is all very well, but you do need hard evidence to back them up (as seen in the Langdell matter).

I think the bottom line here is that not many on TCE really care that much about Evony or their ilk. In the Big Picture it doesn't really matter and we have far more pressing and personal issues to attend to in these difficult times anyway.

This is only my opinion, Bruce, and I do admire you for sticking to your guns and pressing on with your fight against the Big Bad. However, don't imply that folks here should be obligated to support you (financially or otherwise) as that will just get more backs up and you still have, I think, a number of bridges to mend at TCE before you can start asking for favours.
